1. Definitions
Throughout this document:
- "Novasen", "We", "Us", "Our" — refers to Novasen, a home care service provider based at No. 182, Section 2, Jianguo South Road, Yonghe District, New Taipei City 234, Taiwan.
- "User", "You", "Your" — refers to any individual who accesses our website or enquires about or uses our services.
- "Services" — refers to the in-home elderly care arrangements described on this website, including Light Housekeeping & Comfort, Guided Outdoor Activity, and the Complete Residential Care Package.
- "Agreement" — refers to these Terms & Conditions together with any service agreement entered into separately.
- "Website" — refers to the website located at novasenen.info.
2. Acceptance of Terms
By accessing this website or submitting an enquiry, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, please do not use this website or contact us for services.
Use of our services is limited to individuals aged 18 or over who have the legal capacity to enter into a binding agreement. If you are contacting us on behalf of an elderly family member, you confirm you have authority to do so.
3. Service Description
Novasen provides in-home elderly care services in New Taipei City, Taiwan. Our services are described in detail on the website and in service agreements provided to families prior to care commencement.
Service availability is subject to caregiver availability and geographic reach. We reserve the right to assess suitability before confirming any arrangement. Website content is provided for informational purposes and does not constitute a binding offer.
4. User Responsibilities
When using this website and our services, you agree to:
- Provide accurate and complete information when submitting enquiries
- Not use the website for unlawful, harmful, or misleading purposes
- Communicate care-relevant changes to the caregiver and our team in a timely manner
- Treat Novasen caregivers with respect while they are present in the home
- Not attempt to engage Novasen caregivers outside of the agreed service arrangement
5. Service-Specific Terms
For all service types, a formal service agreement will be provided before care commences. Key points include:
- Housekeeping & Outdoor Activity: Schedule changes require at least 48 hours notice. Cancellations with less than 24 hours notice may be charged at the standard session rate.
- Residential Package: Arrangements are confirmed on a monthly basis. Termination of a residential placement requires 30 days written notice from either party unless immediate safety concerns require otherwise.
- All service prices are listed on the website and in the service agreement and are denominated in New Taiwan Dollars (NT$).
6. Payment Terms
Payment terms for each service are outlined in the individual service agreement. Generally:
- Housekeeping and outdoor activity services are invoiced per visit block
- Residential care is invoiced on a monthly basis, payable in advance
- Payments are accepted by bank transfer or other methods specified at the time of agreement
- Late payment may result in temporary suspension of services
Refunds: Unused prepaid amounts for residential care will be refunded on a pro-rated basis upon proper termination notice. No refunds are provided for sessions cancelled with less than 24 hours notice.
7. Intellectual Property
All content on this website — including text, images, and design — is the property of Novasen or used under licence. You may not reproduce, distribute, or use any content for commercial purposes without written permission.
8. Disclaimers
Novasen provides non-medical, in-home care and assistance services. We are not a licensed medical provider. Nothing on this website or communicated by our team constitutes medical advice, diagnosis, or treatment.
Website content is provided "as is" and while we make reasonable efforts to keep it accurate, we make no warranties regarding completeness or fitness for any particular purpose.
9. Limitation of Liability
To the extent permitted by Taiwan law, Novasen's liability for any claim arising from our services is limited to the amount paid for the specific service arrangement that gave rise to the claim.
We are not liable for indirect, incidental, or consequential damages, or for circumstances outside our reasonable control (force majeure), including natural disasters, utility disruptions, or pandemic-related restrictions.
10. Indemnification
You agree to indemnify Novasen against any claims, damages, or costs arising from your breach of these terms, your misuse of this website, or the provision of false or misleading information to us.
11. Termination
Either party may terminate a service arrangement in accordance with the notice period in the service agreement. Novasen reserves the right to suspend or terminate services immediately if there is a risk to caregiver safety or welfare, or in the event of material breach of these terms.
12. Dispute Resolution
We encourage any disputes to first be raised directly with our team by contacting [email protected] or calling +886 4 665 6978. We will endeavour to resolve concerns within 10 business days.
If informal resolution is not achieved, disputes will be subject to the exclusive jurisdiction of the courts of New Taipei City, Taiwan. These terms are governed by the laws of the Republic of China (Taiwan).
13. General Provisions
- Entire agreement: These terms, together with any service agreement, constitute the full agreement between the parties.
- Severability: If any provision is found unenforceable, it will be modified to the minimum extent necessary; remaining provisions continue in full effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement.
- Assignment: You may not transfer your rights under this agreement without our written consent.
14. Changes to These Terms
We may update these terms from time to time. Changes are effective from the "Last Updated" date shown above. Continued use of our website or services constitutes acceptance of any updated terms.
